Test Your Case Without Leaving the Office.

Focus Litigation Consulting’s mock trial and focus group protocols can be conducted in-person or online. Each of these protocols is designed to address case concerns and pretrial preparation needs, to explore and assess juror understanding of key case facts, issues, and law, to identify case strengths and weaknesses, to test key exhibits, demonstrative aids, and witnesses, and to identify critical voir dire questions, themes, and case strategies.

In terms of the most suitable protocol (in-person versus online), the following factors must be considered: (1) the length of time needed to present the case facts and arguments for adequate juror understanding and feedback; (2) the length of the key jury instructions that must be given to jurors for their understanding of the applicable law; (3) the number of questions on the verdict form; and (4) the amount of time needed for jurors to adequately deliberate the case or provide feedback to Focus Litigation Consulting’s consultants.

An online mock trial or focus group lessens the costs associated with the research, but it will limit your attorney/consultant presentation time during the research day. This format is less suitable for comprehensively testing multi-count and particularly complex cases – it is better for focusing on specified aspects of a case, e.g., specifically testing liability, or witness credibility, or damages figures.
