Focus Litigation Consulting is pleased to share that Founding Partner and Senior Trial Consultant, Dr. Geri Fischman, was quoted in national coverage of the highly publicized Johnny Depp v. Amber Heard defamation trial, where every detail – down to hairstyle – was dissected across TikTok and other social media platforms.
The article examined how Amber Heard’s traditional braided updos became a focal point of online commentary during the live-streamed proceedings. In discussing the broader psychological implications, Dr. Fischman explained that high-profile trials today unfold simultaneously in two arenas: the courtroom and the court of public opinion.
“When a case is as public as the Depp trial,” she noted, “litigants not only have to navigate the actual court but also the court of public opinion…The public accessibility to the proceedings has Instagram, Twitter and TikTok pseudo-jurors judging not only the testimony of Heard, Depp and third-party witnesses, but also their appearance, body language, reactions, interactions and mannerisms in the courtroom.”
Dr. Fischman further emphasized that courtroom presentation is rarely accidental. “Hairstyles, like clothing, body language and other visual components of a litigant’s courtroom presence can be used as silent cues to evoke visceral responses in jurors. It can also be effective in furthering and emphasizing a litigant’s case narrative and theme.”
Because the case ultimately hinged on credibility – what many described as a “he said, she said” dynamic – visual presentation took on heightened importance. As Dr. Fischman observed, “by donning old-fashioned hairstyles reminiscent of Laura Ingalls in ‘Little House on the Prairie,’ Heard is attempting to further her defense [and] countersuit narrative of the innocent, helpless, and obedient housewife who suffered silently for years at the hands of her alleged abuser.”
