A mock trial is the most comprehensive research protocol used to test case facts, theories, demonstratives, witnesses, and verdicts. Focus Litigation Consulting’s mock trial research brings counsel and clients face-to-face with a venire of jury-eligible citizens for the purpose of pre-testing a case; obtaining case strengths, weaknesses, and case valuation/verdicts; developing critical pre-trial intelligence; and crafting interventions for jury selection, case presentations, witness testimony, and the selection of research-tested trial strategies and case presentation tactics.

Jurors will participate in a comprehensive written voir dire, followed by viewing formal case presentations presented by counsel and, depending on the scope of the research, witness testimony. Jurors will be surveyed at various intervals throughout the research day for real-time and immediate feedback. Jurors will provide individual verdict decisions as well deliberate the case to a verdict in multiple groups. Jurors will also be debriefed after deliberations to draw additional information, explore the reasoning behind verdicts, and gain any other insights pertinent to counsel.

Counsel will receive real-time juror feedback throughout the research day and watch juror deliberations and any post-verdict interviews, obtaining firsthand insight into the thought process behind juror decision making and verdicts.
Although the scope of a mock trial depends on the specific facts of a case, Focus Litigation Consulting can tailor the research to case specifications and needs. Mock trials range from one day to multiple days in length. We generally recommend that a mock trial be held late in discovery or after discovery deadlines have run, in the months leading up to trial or in anticipation of mediation.
